GENERAL TERMS AND CONDITIONS OF SALE
1) By accepting the order, the customer fully and expressly agrees to all of our terms and conditions of sale and delivery below, declaring that all the clauses included in this order are the result of an agreement following specific negotiations on each item and that, therefore, even the clauses and/or conditions that could in theory constitute cases falling under the provisions of Articles 1341 and 1342 of the Italian Civil Code, being of an essential nature, are valid even if not specifically approved in writing.
2) Prices are for goods delivered free to our factory in Flero. The prices in our price lists are subject to change and are not binding. Any order placed shall only be considered valid if accepted by us by means of an order confirmation.
3) The payment terms specified on the invoice are binding: any changes that have not been expressly agreed in advance will be rejected. Payments made to our registered office in Flero are also considered valid, unless special agreements have been made for deferred payments. Late payment for supplies will result in the charging of interest as provided for by Legislative Decree No. 231 of 2002. In the event of payments not being made within the agreed terms, we reserve the right to suspend deliveries and any orders already accepted. Please note that no payment may be deferred in the event of a dispute. Any additions or changes made by the customer to orders placed by them shall be invalid unless communicated in writing.
4) Delivery times are indicative and not binding, as they are subject to operational possibilities at the time. Failure on our part to comply with the indicated delivery terms does not entitle the customer to cancel the order, defer payments, or claim compensation, indemnities, penalties, or damages of any kind. The above also applies in cases where failure to comply with delivery terms is due to a shortage of raw materials, machinery breakdowns, strikes, lockouts, epidemics, or transport interruptions or delays.
5) Packaging: packaging is invoiced at cost and returns are not accepted; WTS S.p.A. declines all responsibility in this regard.
6) Goods travel at the risk and peril of the customer. Even if the shipment is made carriage paid, the Company declines all responsibility for delays, breakdowns, damage, breakages, or shortages that may occur during transport. It is the customer’s responsibility to submit any complaints to the carrier, even if the latter has been chosen by WTS S.p.A., preferably with a statement of immediate dispute. WTS S.p.A. reserves the right to charge the customer for any additional costs to the pure cost of transport (e.g., stops, special unloading operations, etc.) that may be paid to the carrier.
7) All our items are carefully tested and checked. Our responsibility for the quality of the material is limited, subject to our authorization, to accepting the return, carriage paid, of items found to be defective in order to arrange for their replacement, without being required to pay any compensation. Furthermore, we cannot accept any responsibility if the materials we supply are tampered with. Any compensation for direct or indirect damage caused by the installation of defective material is excluded. Buyers are strictly prohibited from carrying out any further processing on the products we manufacture. We will not accept returned goods unless authorized by us.
8) The illustrations in our catalogs and brochures are intended to demonstrate and represent individual items and therefore do not constitute an obligation of faithful execution. The details, measurements, and weights indicated are to be considered approximate. Therefore, we assume no responsibility for the above and consequently will not recognize claims for damages of any kind. WTS S.p.A. reserves the right to modify the technical characteristics of the products at any time, as well as to modify and/or eliminate models. This catalog cancels and replaces all previous ones.
9) The Court of Brescia shall have exclusive jurisdiction over any disputes, to the exclusion of any other court that may have jurisdiction, even if orders have been placed elsewhere. Any binding statements or guarantees of any kind made by our employees, agents, or representatives that are not included in these general terms and conditions of sale or in documents officially signed by the legal representative of WTS S.p.A. have no value and are not recognized by us.
10) Retention of title.
The sale of goods is subject to retention of title until full payment of the agreed price. From the date of delivery of the goods, however, the buyer shall be solely liable for any risks, dangers, theft, fire, unforeseeable circumstances, damage to property and/or persons and, despite their occurrence, the buyer shall comply with the agreed payment obligations and methods.
PRODUCT CARE INSTRUCTIONS
Chrome Finish
If the product shows signs of limescale or stains, we recommend using natural products (such as a solution of water and vinegar, in a ratio of approximately 3:1), treating the surfaces with a soft cotton cloth. Alternatively, you can opt for mild citric acid-based detergents. Then rinse with water and dry thoroughly.
Special Finishes
To clean all special finishes other than chrome, only use a soft cloth dampened with running water or, alternatively, a very mild detergent (pH neutral). Avoid using abrasive or alcohol-based detergents.
Warning!
The use of unsuitable products may irreparably damage the surface of the taps.
Descaling
Limescale and dirt deposits in the aerator filters can be removed by dismantling the aerator and immersing it in diluted vinegar. Leave to soak for a few hours, wash with soap and water, then rinse.
Spare parts
We recommend using only original WTS S.p.A. spare parts available from authorized dealers.
WARRANTY
Teorema products are rigorously tested and checked before being put on sale. From the date of purchase by the first buyer, they are guaranteed against manufacturing defects for a period of:
1) 10 (ten) years for chrome and stainless steel finishes;
2) 2 (two) years for all other finishes;
3) 2 (two) years for cartridges, valves, diverters, and other components subject to wear and tear.
The warranty covers:
1) Casting defects. Porosity defects. Chrome plating defects.
2) Repair or replacement of the part found to be defective after verification by our technicians and upon presentation of the inspection coupon, proving the date of purchase.
The warranty is not valid in the event of:
1) Deterioration of chrome surfaces due to the use of cleaning products containing acids or abrasive substances.
2) Deterioration of surfaces with finishes other than chrome. Their durability is in fact dependent on the care and delicacy of use by the user.
3) Deterioration of the taps due to incorrect installation.
4) Incorrect use of the taps.
5) Repairs and maintenance carried out in an unsuitable manner and without prior authorization from the Company.
The warranty does not include:
1) Labor costs for the replacement of defective parts, nor claims for compensation for direct or indirect damage suffered or incurred.
The WTS warranty is not renewable.
